These Terms of Service ("Terms") are a legal agreement between you and creox s. r. o. ("Promptit," "we," "us," "our"). By using the Promptit app and related services (the "Service"), you agree to these Terms.

1) Service description
Promptit is a prompt library with optional AI agent for prompt enhancements. Prompts are intended for use with third-party LLMs.
2) Eligibility
You must be 16+ (or the local minimum age) or have valid parental consent if applicable.
3) Accounts
Sign-in via Apple, Google, or email/password. Keep credentials confidential; you're responsible for your account activity. We may suspend/terminate for violations or to protect the Service.
4) Acceptable use
No unlawful, harmful, infringing, or deceptive activity; no reverse-engineering or scraping beyond what's allowed by law; no bypassing security/rate limits; no using the Service to build a competing product or train models without our written permission.
5) Content & IP
You retain rights to your User Content (prompts/notes). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, display, and distribute it solely to operate and improve the Service (including likes/saves). The Service's code, databases, UI, and branding belong to us or our licensors; we grant you a limited, revocable, non-transferable license to use the Service.
6) AI agent & third-party LLMs
Using the agent may send your prompt text to third-party LLM provider(s) to generate enhancements. Outputs can be inaccurate; review before use. When you use external LLMs, their terms/privacy apply. Avoid sensitive personal data in prompts.
7) Privacy (with App Store categories)
Your use of the Service is governed by our Privacy Policy. For transparency, the App may collect Email Address, Product Interaction, Other Usage Data, Performance Data, Other Diagnostic Data, Crash Data, and Advertising Data (only if advertising/attribution is enabled and consented), as described in the Privacy Policy (purposes, lawful bases, retention, and whether data is linked to you).
8) Fees & subscriptions (present or future)
If paid plans are offered, billing and refunds are handled by the platform (Apple/Google). Subscriptions auto-renew unless cancelled at least 24 hours before the period ends.
9) Changes
We may modify features or these Terms. Material changes will be notified in-app or by email where required. Continued use after changes means you accept them.
10) Third-party services
We rely on third parties (Apple/Google sign-in, OpenAI, Sentry & Supabase). They have their own terms and privacy policies. We are not responsible for third-party services.
11) Disclaimers
Service provided "as is." No warranties (to the extent permitted by law), including merchantability, fitness for a particular purpose, non-infringement, or accuracy/reliability of AI outputs.
12) Limitation of liability
To the extent permitted by law: no liability for indirect/special/consequential damages or lost profits/data/goodwill; our aggregate liability is capped at the amount you paid in the prior 12 months (or €50 if you use the free Service). Consumer rights that cannot be limited remain unaffected.
13) Indemnity
You will defend and hold harmless creox s. r. o. from claims/costs arising from your User Content, your use of the Service, or your breach of these Terms or law.
14) Termination
You may stop using the Service anytime; request account deletion in-app (where available) or via info@promptit.sk. We may suspend/terminate for serious or repeated breaches or risk to the Service/users. Sections that should survive (IP, disclaimers, limits, indemnity, governing law) remain in effect.
15) Consumers & withdrawal (EU/EEA/UK)
Platform rules and applicable consumer law apply and prevail where they provide additional protections.
16) Notices & IP complaints
We may send notices in-app, by email, or via platform notifications. For IP complaints, email legal@creox.sk with details; we will respond per applicable law.
17) Governing law & venue
Slovak law governs; Slovak courts have exclusive jurisdiction, except where consumer law mandates otherwise.
18) Miscellaneous
Entire agreement; severability; no waiver; no assignment by you without consent; we may assign in connection with a merger/acquisition/reorganization.
